AKS Legal Secures RUB 460 Million Victory for Energogarant Insurance Company

AKS Legal successfully defended the interests of the claimant, Public Joint-stock Insurance Company Energogarant, in the judicial dispute involving the claim to invalidate the livestock insurance agreement for over RUB 460 million.

The defendant in the case was the largest poultry factory in the Sakhalin Region.

AKS Legal successfully established that the defendant's enterprise suffered significant bird mortality merely five days before securing the insurance agreement. This pre-existing condition, of which the defendant could not have been ignorant, constituted a material non-disclosure. Furthermore, the insurant's misrepresentation to Energogarant regarding the absence of prior mortality was deemed a key factor by the court.

The Commercial Court of the Sakhalin Region ruled in favor of AKS Legal's client, invalidating the contested insurance agreement. The judgment is now final and enforceable.
